Terms of Service

These Terms of Service ("Terms") govern your use of Briefly Daily AI, operated by Jarrod Ward (trading as Briefly Daily AI) ("we", "us", "our"). By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, please do not use this service.

Briefly Daily AI is a subscription-based AI briefing service that connects to your Google (Gmail and Google Calendar) or Microsoft (Outlook mail and calendar) account (with your permission), generates a personalised daily briefing using Claude AI, and delivers it to your nominated email address at your chosen time. The service is provided on a software-as-a-service (SaaS) basis.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

You must be at least 18 years of age to use Briefly Daily AI. By using the service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use at support@brieflydaily.ai. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

By connecting your Google or Microsoft account, you:

• grant Briefly Daily AI read-only access to your Gmail and Google Calendar (Google) or your Outlook mail and calendar (Microsoft);
• confirm that you are authorised to grant this access;
• acknowledge that your use of Google or Microsoft services is also subject to that provider's Terms of Service and Privacy Policy; and
• may revoke Briefly Daily AI's access at any time via your account settings at myaccount.google.com/permissions (Google) or account.live.com/consent/Manage (Microsoft).

6.1 Plans

Briefly Daily AI offers the following subscription plans:

6.2 Free trial

New accounts receive a 30-day free trial with full access to their plan. At the end of the trial, continued access returns to the regular price for the plan you subscribed to.

6.3 Billing

Subscriptions are billed monthly in advance. For subscriptions purchased on our website, payments are processed securely by Stripe; by providing payment details, you authorise us to charge your payment method on a recurring monthly basis. Where subscriptions are offered through the Briefly Daily AI app on the Google Play Store, billing is handled by Google and is subject to Google Play's payment terms.

6.4 Cancellation and refunds

You may cancel your subscription at any time, from your account dashboard for web subscriptions, or via the Google Play Store for any subscription purchased through the app. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months except where required by the Australian Consumer Law; refunds for Google Play purchases are also subject to Google Play's refund policies.

You agree not to use Briefly Daily AI to:

• violate any applicable law or regulation;
• attempt to gain unauthorised access to our systems or other accounts;
• reverse engineer, decompile, or disassemble any part of the service;
• resell or commercially exploit the service without our written consent; or
• share account credentials with third parties.

Briefly Daily AI and all associated content, trademarks, logos, and software are the intellectual property of Jarrod Ward trading as Briefly Daily AI. You are granted a limited, non-exclusive, non-transferable licence to use the service for your personal or internal business purposes.

Briefly Daily AI is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

To the maximum extent permitted by applicable law, Jarrod Ward trading as Briefly Daily AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability to you shall not exceed the total amount paid by you in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under Australian Consumer Law.

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

We will provide at least 14 days' notice of material changes via email or a prominent notice on the website. Continued use after the effective date constitutes acceptance of the updated Terms.

We may terminate or suspend your account at any time for breach of these Terms. Upon termination, your right to use the service ceases immediately.

You may delete your account at any time from your dashboard or at brieflydaily.app/delete-account. Deletion is permanent and cannot be undone. Where we are required to retain billing records for tax or accounting purposes, we retain only those records, as described in our Privacy Policy.
